🧾 Legacy Sealants Inc. – Terms and Conditions

These Terms and Conditions (“Terms”) govern every purchase of products from Legacy Sealants Inc, an Ohio corporation with its principal office in Mentor, Ohio (“Legacy Sealants,” “we,” “us,” or “our”), sold to consumers through our e-commerce platform operating under the trade name Origin Pro Sealants and accessible at www.originprosealants.com (“Origin Pro Sealants”).

By placing an order through Origin Pro Sealants, you acknowledge and agree to be bound by these Terms, as updated from time to time. Legacy Sealants Inc. may revise or amend these Terms at its sole discretion without prior notice, and such revisions become effective upon posting. Your continued use of our website or products following any update constitutes acceptance of the revised Terms.

1. General Terms

Legacy Sealants Inc. reserves the right to revise or update these Terms at any time without prior notice. The most current version will always be available on our website, and it is the customer’s responsibility to review these Terms before making a purchase. Section headings are provided solely for convenience and do not affect the meaning or enforceability of any provision.

2. Product Use and Compliance

Origin Pro Sealants’ professional-grade silicone and hybrid polymer sealants are designed for use in both commercial and residential applications. Customers must follow all usage instructions, safety guidelines, and technical data sheets provided with each product. Certain products may be subject to local or state environmental or regulatory requirements (including, without limitation, California Proposition 65). It is the sole responsibility of the customer to ensure compliance with all applicable laws, codes, and installation practices for the intended use.

Product Suitability Disclaimer:
While Origin Pro Sealants products are formulated for high performance, jobsite conditions, substrates, and application methods can vary significantly. We strongly recommend that all customers test the product under actual or representative conditions to confirm adhesion, compatibility, and performance. No warranty is made regarding suitability for untested or unintended uses. Legacy Sealants Inc. disclaims liability for damage, injury, or loss arising from improper use, misapplication, or storage contrary to product specifications.

3. Order Processing and Delivery

Orders are fulfilled in the order received and are subject to product availability. In-stock orders ship within one (1) business day. Delivery dates are estimates only and are not guaranteed unless expressly confirmed in writing. The customer is responsible for providing accurate and complete shipping information. Origin Pro Sealants is not liable for loss, delay, or additional costs arising from incorrect or incomplete addresses supplied by the customer. Title to and risk of loss for the products pass to the customer upon delivery to the carrier. At this time, we ship exclusively to addresses within the United States.

4. Returns and Refunds

Returns are accepted for unused, unopened products in their original condition within thirty (30) days of receipt. All returns are subject to a fifteen percent (15%) restocking fee unless the return is due to a verified defect or our error. Refunds will be issued, at our sole discretion, following inspection and verification of the returned product.

5. Damaged or Defective Items

Customers must inspect all products upon delivery and notify Origin Pro Sealants Customer Service at orders@originprosealants.com of any damaged or defective items within seven (7) days of receipt. Approved claims will result in either a replacement or a refund.

6. Money-Back Guarantee

If you are not satisfied with your purchase, contact orders@originprosealants.com within thirty (30) days of receiving the product. Refunds remain subject to our sole discretion and may require the return of any unused or unopened product in its original condition.

7. Order Changes and Cancellations

Orders may be modified or cancelled prior to shipment. Once an order has shipped, no changes or cancellations will be accepted, and the standard return policy will apply.

8. Limited Warranty

Legacy Sealants Inc. warrants that its products will conform to the specifications set forth in the applicable technical data sheets at the time of shipment and for the stated shelf life under proper storage conditions. This warranty does not cover damage resulting from misuse, improper application, or storage outside the specified conditions. The exclusive remedy for breach of this warranty is, at our option, replacement of the product or refund of the purchase price.

9. Limitation of Liability

To the fullest extent permitted by law, Legacy Sealants Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities arising out of or related to the use or inability to use our products, even if advised of the possibility of such damage. In all cases, Legacy Sealants’ total liability shall not exceed the purchase price of the specific product, giving rise to the claim.

10. Copyright and Intellectual Property

All content on the Origin Pro Sealants website and on product packaging, including but not limited to text, graphics, logos, and technical data, is the exclusive property of Legacy Sealants Inc. or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. Any unauthorized use is strictly prohibited.

11. Pricing and Promotions

Prices and promotions are subject to change without prior notice. In the event of a pricing error, Origin Pro Sealants reserves the right to correct and adjust the order accordingly or cancel the order with a full refund.

12. Website Use

Use of the Origin Pro Sealants website must comply with these Terms and all applicable laws. We reserve the right to restrict or terminate access at our sole discretion.

13. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict-of-law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Lake County, Ohio.

15. Dispute Resolution and Arbitration

a. Mandatory Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of Origin Pro Sealants products shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction. The arbitration shall be final and binding on both parties.

b. Waiver of Class Actions
To the fullest extent permitted by law, disputes shall be resolved on an individual basis. You and Legacy Sealants Inc. agree to waive any right to participate in or bring class actions, collective actions, or representative actions.

c. Governing Law for Arbitration
The arbitration shall be governed by the laws of the State of Ohio and conducted in Lake County, Ohio.

d. Exceptions
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information.

16. Shipping Policy – Tracking and Transit Times

All orders ship without signature requirement and are processed on business days only (Monday through Friday). Weekend and holiday delivery is not available. A confirmation email will be sent immediately after your order is placed, followed by a shipping confirmation email with tracking details.

In-stock orders ship within one (1) business day. Standard shipping orders typically arrive within three (3) to seven (7) business days, while truck-freight deliveries generally take seven (7) to twelve (12) business days. All delivery timeframes are estimates and not guaranteed.

17. Payment and Chargebacks

All payments are due in full at the time of purchase. Any chargeback or payment dispute initiated by the customer without valid cause constitutes a breach of these Terms. Legacy Sealants Inc. reserves the right to recover all associated costs, including legal fees and collection expenses.
